PLEASE READ THESE SMS/TEXT MESSAGING TERMS & CONDITIONS CAREFULLY. BY PROVIDING YOUR MOBILE TELEPHONE NUMBER, OPTING INTO A TEXT MESSAGING PROGRAM, OR OTHERWISE CONSENTING TO RECEIVE TEXT MESSAGES FROM DAVID PERRY FOR CONGRESS, YOU AGREE TO BE BOUND BY THESE TERMS.

1. PROGRAM DESCRIPTION

David Perry for Congress ("Campaign," "Committee," "we," "our," or "us") may offer one or more text messaging programs to provide subscribers with information relating to:

• Campaign updates
• Election information
• Volunteer opportunities
• Event notifications
• Fundraising communications
• Voter outreach
• Advocacy initiatives
• Public appearances
• Administrative communications
• Other campaign-related information

Participation in any text messaging program is voluntary.

1. CONSENT TO RECEIVE TEXT MESSAGES

By voluntarily providing your mobile telephone number and affirmatively opting into a Campaign text messaging program, you expressly consent to receive recurring automated, manual, autodialed, prerecorded, informational, political, and fundraising text messages from or on behalf of David Perry for Congress at the telephone number provided.

Consent is not a condition of making a contribution, volunteering, obtaining information, or otherwise participating in campaign activities.

You represent and warrant that:

• You are the authorized user of the mobile number provided;
• You are authorized to provide consent for messages sent to that number;
• The information you provide is accurate and current.

1. MESSAGE FREQUENCY

Message frequency may vary.

The Campaign does not guarantee any minimum or maximum number of messages.

Message volume may increase during election periods, fundraising campaigns, volunteer recruitment efforts, major events, emergencies, or other campaign activities.

1. MESSAGE AND DATA RATES

Message and data rates may apply.

Subscribers are responsible for all charges imposed by their mobile carrier, including:

• Text messaging charges
• Data usage charges
• Roaming charges
• Other wireless service fees

The Campaign is not responsible for charges imposed by wireless carriers.

1. SUPPORTED CARRIERS

Text messaging services may not be available through all wireless carriers.

Wireless carriers are not liable for delayed or undelivered messages.

The Campaign makes no guarantee regarding message delivery, timing, availability, or performance.

1. OPTING OUT

You may opt out of receiving text messages at any time.

To stop receiving text messages:

Reply STOP to any Campaign text message.

Upon receipt of a valid STOP request, the Campaign will make reasonable efforts to remove your number from the applicable text messaging program.

You may receive a final confirmation message confirming your opt-out request.

Opting out of one messaging program may not automatically remove you from all Campaign communications.

1. TELEPHONE NUMBER CHANGES

If you change, transfer, relinquish, deactivate, or reassign your mobile number, you agree to notify the Campaign before the change takes effect.

Failure to do so may result in messages being sent to an unintended recipient.

The Campaign shall not be liable for damages resulting from a subscriber's failure to update contact information.

1. PRIVACY

Information collected through text messaging programs is governed by the David Perry for Congress Privacy Policy.

The Campaign may collect and maintain:

• Mobile telephone numbers
• Subscription information
• Message history
• Communication preferences
• Delivery records
• Campaign engagement information

Such information may be used for lawful campaign, administrative, compliance, fundraising, and communication purposes.

1. MOBILE INFORMATION PROTECTION

No mobile information will be shared with third parties or affiliates for their own marketing or promotional purposes.

The Campaign may share information with service providers, vendors, consultants, compliance professionals, legal advisors, technology providers, and messaging platforms solely to facilitate Campaign operations and communications.

Information sharing remains subject to applicable law and contractual obligations.

1. CAMPAIGN FINANCE COMPLIANCE

Certain communications may include fundraising solicitations or contribution requests.

Contributions remain subject to applicable federal election laws and regulations.

The Campaign reserves the right to request information necessary to verify contribution eligibility and comply with applicable legal requirements.

Nothing contained in these Terms limits the Campaign's obligations under federal campaign finance law.

1. PROHIBITED USE

Subscribers agree not to:

• Use the messaging program for unlawful purposes;
• Interfere with system operations;
• Attempt unauthorized access to messaging systems;
• Submit false or misleading information;
• Impersonate another person;
• Engage in abusive or disruptive conduct.

The Campaign reserves the right to terminate participation for violations of these Terms.

1. NO GUARANTEE OF DELIVERY

Text message delivery depends upon factors outside the Campaign's control, including:

• Carrier network availability
• Mobile device settings
• Technical limitations
• Service interruptions
• Force majeure events

The Campaign does not guarantee that any message will be received, transmitted, delivered, or read.

1. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALL TEXT MESSAGING SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

THE CAMPAIGN DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF:

• MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• AVAILABILITY
• ACCURACY
• RELIABILITY

1. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAVID PERRY FOR CONGRESS, ITS OFFICERS, REPRESENTATIVES, VOLUNTEERS, AGENTS, CONSULTANTS, CONTRACTORS, VENDORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY:

• INDIRECT DAMAGES
• INCIDENTAL DAMAGES
• SPECIAL DAMAGES
• CONSEQUENTIAL DAMAGES
• PUNITIVE DAMAGES
• LOSS OF DATA
• LOSS OF BUSINESS
• LOSS OF PROFITS
• COMMUNICATION FAILURES

ARISING FROM OR RELATED TO PARTICIPATION IN ANY TEXT MESSAGING PROGRAM.

1. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless David Perry for Congress and its officers, volunteers, agents, consultants, contractors, representatives, and affiliates from claims, liabilities, damages, losses, expenses, and attorneys' fees arising out of:

• Your violation of these Terms;
• Your provision of inaccurate information;
• Your misuse of the messaging program;
• Your violation of applicable law.

1. MODIFICATION OR TERMINATION

The Campaign reserves the right to:

• Modify any messaging program;
• Suspend any messaging program;
• Terminate any messaging program;
• Change message content;
• Change message frequency;
• Discontinue messaging services entirely,

at any time and without prior notice.

1. GOVERNING LAW

These Terms shall be governed by:

• Applicable federal law of the United States; and
• The laws of the State of Alabama,

without regard to conflict-of-law principles.

1. DISPUTE VENUE

To the fullest extent permitted by law, disputes arising under these Terms shall be brought exclusively in a court of competent jurisdiction located within the State of Alabama unless federal law requires otherwise.

1. SEVERABILITY

If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.

1. CHANGES TO THESE TERMS

The Campaign reserves the right to revise these SMS/Text Messaging Terms & Conditions at any time.

Updated versions become effective upon posting.

Continued participation in a messaging program constitutes acceptance of any revised Terms.
